Road Accident Fund Claims
We assist clients who were injured in a road accident or breadwinners who were employed and died as a result of the road accident. If you are injured in a road accident, you can claim for three things namely general damages for pain and suffering and/or loss of amenities of life or disfigurement, loss of earnings or earning capacity and past and future medical expenses. For general damages you must prove that your injuries are serious by submitting a completed RAF 4 form from a medical practitioner which confirm that your injuries result in 30% or more Whole Person Impairment (WPI) or meet the “narrative test” being that the injuries resulted in a severe long term impairment, disfigurement etc. For loss of earnings claim you must prove that you are employed or will be unable to work or earn an income as a result of the motor vehicle accident. In other words you must proof that you were employed at the time of the accident by producing salary advice, tax records and employer certificate. If you were self employed, you must produce financial statements, tax returns and proof of business loss. For past medical expenses you must produce vouchers or invoice for medical treatment received and for future medical expenses, medico legal reports will suffice and on this claim the Road Accident Fund furnishes an undertaking to pay future medical expenses or treatment.
